Summary: $$ for 386bsd

I know a certain company is distributing 386bsd on CD-ROM, and charging
money for it.  What is legal to charge money for, and what is not?
Specifically, I would like to include 386bsd as an OS for which
I could custom-install on a certain platform, perhaps even
binary-only.  Opinions, anyone?
