According to Webster, plagiarism is "1: an act or instance of plagiarizing 2: something plagiarized." (Isn't that just like Webster? :-) Anyway, plagiarize is defined as "vt [plagiary] (1716): to steal and pass off (the ideas or words of another) as one's own : use (a created production) without crediting the source ~ vi : to commit literary theft : present as new and original an idea or product derived from an existing source." Hence, plagiarism which derives from a copyrighted source is a violation of the copyright, which is very much a legal issue.
