I don't think MS is going to litigate them out of business, and a suit over using a trademark (UNIX) to refer to his own product without permission (and it's real tough for Bill Gates to claim he doesn't speak for MS) would not be the first suit MS got from the place that owns USL. The place that used to own it isn't exactly small potatoes, either.
