I would liken UNIX more to "Cola" than to "Coke", thus being more like zipper, etc. It used to be that BSD UNIX was very different from the AT&T version. You might think that, but USL doesn't, and they're the ones doing the suing. The difficulty comes in persuading a judge/jury who probably aren't terribly computer-literate that Unix* is in common generic usage among computer professionals. No one has ever said that the legal system follows common sense.
