The discussions about the agreement I saw indicated that this issue was raised by the FreeBSD folks at the time and USL said that was cool. In fact, people have gone to great lengths to make sure there are mirror sites setup all over the world, so that when July 31 rolls around, people can still get copies of FreeBSD.
