Shannon proved the maximum rate of information transfer given frequency range available and signal/noise ratio. The other guy (I don't remember his name) proved the maximum rate of state changes (which is bitrate when you only have 2 states). I know 9600 bps modems still run at 2400 state changes/second; I have no reason to think that 28.800 modems run any faster; they just have a larger statespace.
