The command set, no.  However, BIZCOMP (remember them) had a patent on the +++
escape sequence (which I believe was finally held to be invalid).  Hayes does
have a patent on the pause before and after the +++.  Hayes has gone to court
over this patent many times and, to the best of my recollection, has always
won.  I don't believe they always started the litigation.
