Whether or not UNIX is a trademark, anyone choosing to argue the point in court had better have lots of money for just the lawyers, let alone the costs if they lose. Abstract notions of right or wrong or mathematical treatments of the relevant statues don't necessarily have much to do with whether you win or lose in court, especially if you can't afford to even enter the game.
