This is doubtful, unless there is some provision of German law that would validate their claim... but of course you said "could sue" rather than "could sue and win", so you're probably correct. I'd have to say that in my opinion a large amount of what UNIX Magazin publishes reflects badly on it. But maybe that's just me... I have the same unwarranted problem with the National Enquirer. 8-).
