(I think it would be ] struck down if considered, under UCC 2-207, by the way). I do not believe it has ever been considered at an apellate level -- that is, no binding case law has resulted. The test, AFAIK, have all been in regional jurisdictions. The upholds were in Missouri (ironic: "The Show Me State") and Michigan. I know about the Utah case because a friend of mine was an expert witness. Does LEXIS cover non-binding cases?
