The BSD source before 4.4-lite is not free since it contains proprietary code from AT&T (now property of Novell or whoever owns the right to the UNIX source code this week). Technically the released source before 4.4-lite has not been shown to contain proprietary code as it has never been tested in court. In fact most people would go further and say that there wasn't any proprietary code in the released versions, and that may be the reason USL (who owned Unix at the time) never actually went to court. Besides large parts of the BSD source tree were never in any dispute and are still today available from the net (though are not quite so common given the plethora of excellent free Unix systems around, including one from SCO who currently own Unix). ftp://sunsite.doc.ic.ac.uk/unix/ contains both 4.3bsd-reno and 4.3bsd-net2 You might find stuff going back to '89 there.
